1. Introduction

Welcome to CardMatch. These Terms of Service ("Terms") govern your access to and use of the CardMatch platform, website, and services (collectively, the "Service"). By accessing or using CardMatch, you agree to be bound by these Terms.

2. Acceptance of Terms

By creating an account or using CardMatch, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

3. Description of Service

CardMatch is a matchmaking and listing platform for card collectors. We provide a service that allows users to:

• Create listings for trading cards they own
• Browse listings from other collectors
• Connect with other users who have matching trade interests
• Communicate about potential trades

Important: CardMatch does NOT process transactions, facilitate payments, or handle the physical exchange of cards. We are a matchmaking platform only. All trades are arranged directly between users.

4. User Accounts

To use CardMatch, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use
• Be at least 13 years of age (or have parental consent)

5. User Content

You are solely responsible for the content you post on CardMatch, including listings, images, descriptions, and messages. You represent and warrant that:

• You own or have the right to post the content
• Your content does not violate any laws or third-party rights
• Your listings accurately represent the cards you own and wish to trade

By posting content, you grant CardMatch a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

6. Prohibited Conduct

You agree NOT to:

• Post false, misleading, or fraudulent listings or information
• Harass, threaten, or abuse other users
• Use the Service for any illegal purpose or to violate any laws
• Attempt to gain unauthorized access to the Service or other users' accounts
• Scrape, data mine, or use automated tools without permission
• Post spam, advertisements, or promotional content
• Impersonate any person or entity
• Sell counterfeit cards or misrepresent the condition of cards

7. Intellectual Property

CardMatch and its original content, features, and functionality are owned by CardMatch and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our express permission.

Card game names, logos, and card images are trademarks of their respective owners (Pokémon, Magic: The Gathering, Yu-Gi-Oh!, etc.). CardMatch is not affiliated with or endorsed by these companies.

8. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

CardMatch makes no warranties, express or implied, regarding:

• The accuracy or reliability of user-generated content
• The completion of any trades between users
• The condition, authenticity, or value of cards listed
• The conduct or trustworthiness of users you interact with
• Uninterrupted or error-free operation of the Service

YOU ASSUME ALL RISKS ASSOCIATED WITH TRADING CARDS WITH OTHER USERS. WE STRONGLY RECOMMEND CONDUCTING TRADES SAFELY, VERIFYING CARD CONDITIONS, AND USING TRACKED SHIPPING METHODS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDMATCH SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Damages arising from trades between users, including failed trades, disputes, fraud, or misrepresentation
• Damages resulting from lost, damaged, or counterfeit cards
• Damages arising from service interruptions or data breaches

Our total liability to you for all claims shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Prolonged inactivity
• Any reason we deem necessary to protect the Service or users

You may delete your account at any time through your settings.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of CardMatch after changes take effect constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which CardMatch operates, without regard to conflict of law principles.
